Akira Eiland: Eiland v. Raper

2017-03-27 22:27:12 nstyle

I recently had the opportunity to talk with Akira Eiland. Eiland is fighting a battle that most homeowners couldn’t even begin to imagine. Eiland has been living in her Waterford Pointe Subdivision home in Henry County since 2010. She purchased her dream house because it was declared lake-front property. Thinking that this would be the place where her husband and their 4 children would reside for the rest of their lives. She knew her father and uncle loved to fish so it was a no-brainer if this was the perfect house for her. Well her dream house became a nightmare in 2013. Enter Ann Raper a Southern Belle who purchased the lake and 11 parcels of land that were part of the foreclosed subdivision that developer Clyde Stephens of Greenleaf Development Inc. did not complete the Waterford Pointe Subdivision on nor were the homeowners notified of the foreclosure. Raper purchased the property for $8,000 in 2011, making her the new owner of the lake. In 2013 Raper decided to call the police and have Eiland arrested for trespassing. Trespassing on the lake front property that Eiland’s homeowner paperwork states that she is the owner. Eiland will never forget the night she returned home from enjoying an Anniversary dinner with her husband. The Henry County Police had a warrant for her arrest. Imagine being told you are trespassing on lake front property that you paid $236,000 for. 42 other homes in the subdivision were also sold as lakefront property, many of the residents are African-American older couples . In 2013, the Waterford Pointe Subdivision homeowners association wrote a letter to Raper trying to reaching a common ground. This did not got over well, as Raper did not respond for months. Instead of a response from Raper, the homeowners association received a letter from her attorney, Andrew Jackson Welch Jr.. After the first incident with the Henry County Police, there were 30 additional instances in which the police came out to Eiland’s home. The came out so frequently that Eiland knew the police by their names and even knew the Chief of Police. Eiland has employed the Alexander Law Firm, P.C. to fight the battle which she feels encompasses discriminatory practices against her. It has cost Eiland well over $30,000 in legal fees to file this case. Eiland is currently requesting the Georgia Supreme Court to grant an appeal which cost $16,000. Which is why the other neighbors in Eiland’s community haven’t been able to join the lawsuit. There is no telling how long the appeal process could take. At this point, Eiland feels threatened in her own home. Raper walks in front of Eiland’s house twice a day, two of her cars has been vandalized twice. At the end of the day, Eiland wants her freedom. She is a woman of faith praying to God to give them justice. -Skye Smith @skyebutterfli
